WAIVER OF LIABILITY AND ASSUMPTION OF RISK

By submitting this application the registrant undersigned, hereby agrees to waive any and all liability and indemnify the Kansas City Area Pyrotechnicians (KCAP) and each of its members, directors, officers and agents from and against all claims, injuries, or damages direct or consequential from any level of participation in activities associated with Kansas City Area Pyrotechnicians. This would include but is not limited to: displays, demonstrations, seminars, training, transportation of fireworks and educational materials. The undersigned further agrees to assume liability and supervise their minor children at all times.

I affirm that the facts set forth in it are true and complete. I understand that if I am accepted as a member, any false statements, omissions, or other misrepresentations made by me on this application may result in my immediate dismissal. I hereby state I have read the waiver, and will agree to strictly abide by the waiver, all bylaws, and safety rules of the Kansas City Area Pyrotechinicians. Violations of the above said bylaws and rules is cause for immediate suspension of activities and privileges,
which may result in expulsion.

GROUP BUYS AND PAYMENT FACILITATION

KCAP may provide online ordering and payment tools as a convenience for members participating in club group buys. KCAP is not the manufacturer, supplier, distributor, shipper, or seller of products offered through a group buy unless KCAP expressly states otherwise in writing. Each member is responsible for evaluating the product, supplier, price, shipping, delivery, storage, use, and legal compliance of any purchase.

To the fullest extent permitted by applicable law, KCAP, its members, directors, officers, volunteers, and agents are not responsible for product availability, quality, condition, safety, legality, shipping, delivery delays, vendor performance, payment-processing interruptions, refunds, chargebacks, or any loss, damage, injury, cost, or claim related to a group buy or related transaction. Nothing in these terms limits or excludes liability that cannot be waived under applicable law.
